DATA PROTECTION PRIVACY POLICY

The remit of the Tay Liaison Committee (TLC) is to administer the River Tay Protection Order in accordance with the clauses in 1976 Freshwater and Salmon Fisheries (Scotland) Act, along with the subsequent amendments, as detailed in the Acts from that date to the present.

The Committee comprises nominated representatives of angling clubs, associations, co-optees and other groups involved in activities on the River Tay, whose representatives signed the reinstatement of the Order application in 1998. The Office Bearers are the Chair, Vice Chair, Secretary, Minute Secretary, Treasurer and Recorder, all elected at the AGM. The Constitution sets out the terms of reference as updated when required.

The Administration Management is as laid out in the 1998 Submission Document with amendments as required and binds all the signatory organisations to follow and comply with these.

To comply with the requirements of the General Data Protection Revisions (GDPR).

The Recorder,   Alex J.M. Stewart, 2 Dochart Road, Killin, Perthshire. FK21 8SN has been appointed as the Officer detailed to handle the confidential information and correspondence.

All the requested details and correspondence must be submitted to him and to no other party. Confidentiality will thus be complied with.

The dedicated Email is tayprotectionorder@yahoo.com  All must register for the new data bank by sending their contact email to the above email and there after all responses will only be sent from this email address.

WHAT THE TLC REQUIRE

ANGLING CLUBS AND ASSOCIATIONS

The Name, Postal Address, Contact Telephone Number and Electronic Mail Address, of the following.

Secretary : The Representative nominated to be a Member of the TLC : Any Other Officer deemed necessary by the TLC or Angling Club.

The Original, up to date, Access Agreement Form for all Riparian Owners with whom there is an arrangement, for Club or Association Members, and Visitors, to avail themselves of the beat(s) via Membership Dues or Purchasing a Permit. Written permission of each Riparian Owner with whom the Club or Association has such an arrangement to allow their contact details to be stored on the secure data bank.

Full Contact Details of Permit Sale Outlets along with the written permission of the Outlet Owner to allow these to be published on the TLC Web Site. Any details for the provision for Out of Hours Permit Sales.

 

OTHER ORGANISATIONS

The Name, Postal Address, Contact Telephone Number and Electronic Mail Address, of the following.

Representatives of Other Organisations, having an interest in the River Tay System, and were signatory to the 1998 Submission Document.

 

RIPARIAN OWNERS

The Name, Postal Address, Contact Telephone Number and Electronic Mail Address, of the following.

1.         Riparian Owners who administer their own Beats

2.         Agents of Riparian Owners who deal with making the annual returns on their behalf.

3.         The Original, up to date, Access Agreement Form allowing Visitors to avail themselves of the fishing on purchasing a permit.

4.         Full Contact Details of Permit Sale Outlets along with the written permission of the Owner to allow these to be published on the TLC Web Site.

 

WHY WE NEED THE DETAILED INFORMATION

ANGLING CLUBS AND ORGANISATIONS

1.         The TLC require to hold an up to date record of all Clubs and Organisations for the purpose of communicating administration information and requesting information for the   Annual Report.

2.         The TLC require to hold an up to date record of the Club or Organisations’ Representative on the TLC for communicating information and circulating Agendas and Minutes.

RIPARIAN OWNERS

1.         The TLC require to hold an up to date Data Base of the full details of each Riparian Owner, and/or their Agent, for the purpose of communicating information, requesting information for the Annual Report via the yearly return forms.

WHO WE SHARE YOUR INFORMATION WITH

The Information held on the TLC Data Bank will be published on the TLC Web Site in part or full. This is for the purpose of Permit Sales and local points of contact for a variety of legitimate reasons including weather conditions, how the fishing returns are, and to request additional information in connection with Freshwater Angling.

The TLC may be required to share information with statutory or regulatory authorities and organisations to comply with statutory obligations. Such organisations include Marine Scotland, The Health & Safety Executive, Disclosure Scotland, and Police Scotland.

The TLC may also share personal information with our professional and legal advisors for the purposes of taking advice.

If information is included in any images or videos taken at events, we may share this with local newspapers and journals for promotional and/or journalistic purposes

In the event that The TLC do share personal information with external third parties, it will only share such information strictly required for those specific purposes and take reasonable steps to ensure that recipients shall only process the disclosed information in accordance with those purposes.

 

HOW WE PROTECT THE INFORMATION

All the TLC information is stored on an electronic filing system and our servers are based in the UK and is accessed only by the TLC appointed Officer for the purposes set out above.

The Information is further backed up on an external Hard Drive with each section of the Data Bank PASSWORD PROTECTED.

 

HOW LONG WE KEEP THE INFORMATION

The TLC will only keep the information for as long as necessary to provide a comprehensive Administration System.

It is the duty of all who provide the requested information to ensure it is up to date and relevant.

The TLC cannot be held responsible for out of date information, lack of information or wrong or incomplete information which is supplied by Angling Clubs, and Associations or Riparian Owners.

YOUR RIGHTS

Clubs and Riparian Owners can exercise any of the following rights by writing to The TLC Recorder.

            1.         The right to request access to the information that the TLC hold by making a   “subject access request”

2.         If you believe that any of the information supplied and published is inaccurate or incomplete, you have a right to request that we correct or complete such information.

3.         You have a right to request that The TLC restrict the processing of information for specific purposes, and if you wish us to delete information, you may request that The TLC do so.

Any requests received by The TLC will be considered under applicable data protection legislation. If you remain dissatisfied, you have a right to raise a complaint with the Information Commissioner’s Office at www.ico.org.uk
